Policies & Terms of Services

This Terms & Conditions Agreement is between ONE MAX TECHNOLOGY SDN BHD and Customer, and the person (individual or legal person) whose signs ONE MAX TECHNOLOGY SDN BHD service order and set up form (the "Order" ) incorporating this Agreement by reference ("Customer"). This Agreement governs Customer'ss use of ONE MAX TECHNOLOGY SDN BHD service. By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.

ONE MAX TECHNOLOGY SDN BHD Hosting Policies

All accounts at ONE MAX TECHNOLOGY SDN BHD are bound by ONE MAX TECHNOLOGY SDN BHD policies. Violation of these policies can result in warnings, account suspension, account termination and/or legal action, depending on the severity of the violation.

ONE MAX TECHNOLOGY SDN BHD Terms of Service

Where the content states: "We" includes ONE MAX TECHNOLOGY SDN BHD or any party acting on ONE MAX TECHNOLOGY SDN BHD implicit instructions. "You" includes the person purchasing the services or any party acting on the customer’s instructions. "Member" includes the purchaser of services or any party acting on the purchaser's instructions. "Server" means the computer server equipment in connection with the provision of the Services. "Web Site" means the area on the Server allocated by us to you for use by you as a site on the Internet. "TOS" includes this agreement. In consideration of the mutual covenants herein, the parties agree to the following, which shall apply during the term of this agreement:

Lawful use

Customers may not use ONE MAX TECHNOLOGY SDN BHD facilities and capabilities to conduct, or solicit the performance of, any illegal activity, or to conduct any other activity which infringes on the rights of ONE MAX TECHNOLOGY SDN BHD or any third party.-

Inappropriate material

ONE MAX TECHNOLOGY SDN BHD accounts may not host or handle material that contains nudity, pornography, adult material, obscenity, discriminatory/hate propaganda, " warez ", hacking-related material, material which promotes the illegal distribution of software, or any material that results in reasonable and legal based complaints from other customers or third parties.-

Intellectual property rights

Customers may not upload or transmit any message, data, image or program that would violate the property rights of others. This includes the unauthorized transmission of copyrighted text, images, music, programs, or trade secrets or other confidential and proprietary information, trademarks, service marks or trade names used in an infringing manner.

Customers may not upload or transmit any information which is libelous or defamatory, or which violates or infringes on any right of privacy of any person.-

Interference with service

There shall be no attempt to gain unauthorized access to ONE MAX TECHNOLOGY SDN BHD systems or accounts, disrupt service or connectivity, misuse ONE MAX TECHNOLOGY SDN BHD facilities, or create fraudulent accounts.-

Viruses

In the event that any virus or destructive element is found or furnished with any content, the customer will use their best efforts upon learning that such situation exists, to immediately eliminate the virus or destructive element. Customer will notify ONE MAX TECHNOLOGY SDN BHD as to the existence of any such virus or destructive element immediately upon discovery thereof, and ONE MAX TECHNOLOGY SDN BHD will have the right to take any steps it deems necessary to eliminate the virus or destructive element and to be reimbursed by the customer for its costs relating to any such commercially reasonable steps.-

Unacceptable messages

The use of ONE MAX TECHNOLOGY SDN BHD servers as the source, intermediary, or destination address involved in the transmission of unacceptable messages is prohibited. In addition, no ONE MAX TECHNOLOGY SDN BHD -hosted domain or ONE MAX TECHNOLOGY SDN BHD server may be listed in any unacceptable message. The use of ONE MAX TECHNOLOGY SDN BHD servers to send or relay such messages is also prohibited.

ONE MAX TECHNOLOGY SDN BHD defines an "unacceptable message" to be any mass message in any medium, whether solicited or unsolicited, which results in complaints from recipients of that message. Transmission of, or soliciting the transmission of, any "unacceptable message" will result in suspension of service until which time as complaints cease, or the immediate termination of all services without refund, at our discretion.

Any customer who is repeatedly flamed/mail-bombed or attracts such behavior will have his or her services terminated.

ONE MAX TECHNOLOGY SDN BHD mailing list services are provided for use as discussion forums only, and may not be used to distribute unsolicited email. All users on a list must have personally subscribed to that list.

Subhosting

ONE MAX TECHNOLOGY SDN BHD services are provided for end users only. No subhosting or resale of any services, for fee or for free, is permitted without the express written consent of ONE MAX TECHNOLOGY SDN BHD .

CGI usage

CGI, FreeCGI , SSI , Miva , HTMLScript , and other CPU-intensive features utilize server CPU-time which is drawn from a common pool shared by all users on a particular system. Any site which monopolizes the CPU, causes disruption of service, or negatively impacts server performance will not be allowed. ONE MAX TECHNOLOGY SDN BHD reserves the right to immediately terminate any harmful CGI process.

Resource usage

ONE MAX TECHNOLOGY SDN BHD does not meter or explicitly limit site traffic (bandwidth). Bandwidth is not billed, but is drawn from a common pool shared by all accounts. Accounts using more than 10GB per month may be subject to certain restrictions.

CGI, FreeCGI, SSI, Miva, PHP, database services, and other CPU-intensive features utilize server CPU-time which is drawn from a common pool shared by all users on a particular system. Any site which monopolizes the CPU, causes disruption of service, or negatively impacts server performance will not be allowed.ONE MAX TECHNOLOGY SDN BHD reserves the right to immediately terminate any harmful CGI process.

Any account which, due to extraordinary resource utilization, negatively impacts other customers, will be required to reduce resource utilization, or move to a dedicated server environment.
Any shared account using more than 10gb of disk space / 50% of disk space usage will not be subjected to FREE DOMAIN . There is currently an limit of 50k inodes on both shared hosting account . Shared and Reseller servers only allow 50,000 inodes per account . If the account exceeds 50,000 inodes then it will be in violation of our Acceptable Use Policy and may be flagged for review and/or suspension.

The storage capacity provided with the hosting plan you have purchased is defined as disk space. It is used in order place content such as your web pages, databases and email accounts. You can not use the provided disk space as backup storage, medium for file transfer (via FTP, HTTP and etc.), or file sharing storage except in dedicated hosting. In order to use this space for shared hosting, you have to respect the following conditions: You may only store your website's content. It is forbidden to use it for personal or unrelated pieces of data that are not part of your website. If ONE MAX TECHNOLOGY SDN BHD detects you are using the disk space for other purposes, ONE MAX TECHNOLOGY SDN BHD can end the hosting contract and terminate your account.

Email Storage Usage Limitation

Email services provided by ONE MAX TECHNOLOGY SDN BHD. within web hosting packages comes with usage quota restriction described as follows: usage for EACH email accounts in 1 hosting account must not exceed 5GB in storage spaces. This email storage usage policy is applicable to ALL ONE MAX TECHNOLOGY SDN BHD.'s web hosting hosting packages, however, does not affect vDedicated Server and Dedicated Server packages. Users whose email storage usage exceed the aforementioned quota will be advised to upgrade their service package to Dedicated Server package.

Backups and Data Loss

ONE MAX TECHNOLOGY SDN BHD automatic backup service runs once a week on a random day, and each run overwrites any previous backups. Only one week of backups are kept at a time. The terms of our backup policy vary depending on the type of hosting account. Your use of the Services is at your sole risk. This service is provided only to shared and reseller accounts as a courtesy and may be modified or terminated at any time at ONE MAX TECHNOLOGY SDN BHD sole discretion. ONE MAX TECHNOLOGY SDN BHD does not maintain backups of dedicated accounts. ONE MAX TECHNOLOGY SDN BHD is not responsible for files and/or data residing on your account. You agree to take full responsibility for all files and data transferred and to maintain all appropriate backup of files and data stored on ONE MAX TECHNOLOGY SDN BHD servers. Shared Hosting accounts that exceeding 10 Gigabytes in total storage space / 50% of current plan storage space will automatically be removed from our backup system without prior notice . ONE MAX TECHNOLOGY SDN BHD backups are provided as a courtesy and are not guaranteed. Customers are responsible for their own backups and web content and should make their own backups for extra protection . Customer agrees to maintain a current copy of all content hosted by ONE MAX TECHNOLOGY SDN BHD notwithstanding any agreement by ONE MAX TECHNOLOGY SDN BHD to provide backup services.

Disclaimer

ONE MAX TECHNOLOGY SDN BHD shall not be responsible for any damages your business may suffer. ONE MAX TECHNOLOGY SDN BHD makes no warranties of any kind, expressed or implied for the Services. ONE MAX TECHNOLOGY SDN BHD disclaims any warranty of merchantability or fitness for a particular purpose, including loss of data resulting from delays, delivery failures, wrong deliveries, and any and all service interruptions caused by ONE MAX TECHNOLOGY SDN BHD or our employees.

Liability

Customer is solely responsible for the conduct of the Customers business and all other matters under Customers control. IN NO EVENT SHALL ONE MAX TECHNOLOGY SDN BHD , ITS PARENT, SUBSIDIARIES, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, REPRESENTATIVES OR LICENSORS, OR ANY OTHER PARTY INVOLVED IN PRODUCING, CREATING OR DELIVERING ONE MAX TECHNOLOGY SDN BHD SERVICE, TECHNOLOGY OR CONTENT, BE LIABLE TO The Client IN ANY MANNER WHATSOEVER FOR LOSS OF OR INACCURACY OF DATA, GOODS, REVENUES, PROFITS, SERVICES, OR TECHNOLOGY OR FOR ANY DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SIMILAR DAMAGES, EVEN IF ONE MAX TECHNOLOGY SDN BHD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The Client HEREBY WAIVES ANY AND ALL CLAIMS AGAINST ONE MAX TECHNOLOGY SDN BHD AND ITS PARENT, SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF CUSTOMERS USE OF ONE MAX TECHNOLOGY SDN BHD SERVICE.

Limitation of Damages

NEITHER PARTY SHALL BE LIABLE TO EACH OTHER FOR ANY LOST PROFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE LOSS OR DAMAGE OF ANY KIND, OR FOR DAMAGES THAT COULD HAVE BEEN AVOIDED BY THE USE OF REASONABLE DILIGENCE, ARISING IN CONNECTION WITH THE AGREEMENT, ANY ADVISESHALL BE TAKEN AT THEIR OWN RISK. NOTWITHSTANDING ANYTHING ELSE IN THE AGREEMENT TO THE CONTRARY, THE MAXIMUM AGGREGATE LIABILITY OF ONE MAX TECHNOLOGY SDN BHD SHALL NOT TO EXCEED THE AMOUNT PAYABLE BY CUSTOMER FOR THREE MONTHS OF SERVICE.

Customer privacy

ONE MAX TECHNOLOGY SDN BHD respects the privacy of its customers, and will not sell or trade the names and addresses of its customers. ONE MAX TECHNOLOGY SDN BHD does not require customers to be listed in ONE MAX TECHNOLOGY SDN BHD customer directory. ONE MAX TECHNOLOGY SDN BHD reserves the right to provide contact information upon request in matters relating to potential legal action, flagrant abuses, as required by law, or when appropriate contact information can not be found on the customer's website.

Criminal prosecution

There are numerous federal, state and international laws regulating the use of the Internet. ONE MAX TECHNOLOGY SDN BHD will not hesitate to initiate criminal prosecution and/or cooperate with government agencies relating to misuse of ONE MAX TECHNOLOGY SDN BHD services or systems.

Refusal of service

ONE MAX TECHNOLOGY SDN BHD reserves the right to refuse service to anyone at its sole discretion.

Promotional services and prices

ONE MAX TECHNOLOGY SDN BHD may cancel specials or promotions at any time for any reason. Prices are subject to change at any time, and prices are only guaranteed for the initial period of prepayment.

Billing & Refund Policy

We offer a 3-Day Money-Back Guarantee with no questions asked. If for any reason you are not satisfied with our product or service, you can request a full refund within 3 days from the date of purchase / payment . No explanation is required, and you will not be asked any questions. This refund guarantee applies to all products and services purchased directly from us.
Non-Payment of services shall result in a 24-hour grace period, starting at 12:00 a.m. (in the morning) on the billing due date, before disconnection of services. All payment failures must be cured within the 24-hour grace period. Customers failing to secure payment within the grace period will incur service interruption ; Customers will be subject to a Rm100 each time reconnection fee.
Service cancellations must be submitted in writing (to "sales@1maxhosting.com") at least 20 business days before your next billing cycle.
Company is not responsible for data integrity on equipment or accounts reclaimed or suspended for non-payment. For any plan with Free Domain do not provide EPP Code for EPP Code Activation will charge RM100 ( one time fee ) We reserve the right to modify or discontinue this policy at any time.

Entire Agreement :
These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.
ONE MAX TECHNOLOGY SDN BHD reserves the right to amend these TOS at any time.
It is your responsibility to check these Terms of Service on occasion for any such amendments.
